These Terms of Service ("Terms") form a legally binding agreement between you ("Practitioner", "you", or "your") and Expand Health (Pty) Ltd ("Expand Health", "we", "us", or "our"), governing your access to and use of the Expand Health platform, including all web applications, APIs, AI features, and related services (collectively, the "Service").
By creating an account, clicking "I agree", or otherwise accessing the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you are accepting on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must not use the Service.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at security@expandhealth.io if you suspect any unauthorised access.
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
We offer a 14-day free trial to new accounts. During the trial period you have access to all features of the Service. No credit card is required to start a trial.
You may use the Service solely for your internal business purposes as a healthcare practitioner or clinic, including managing patient records, generating clinical documentation, and using AI-assisted features for clinical workflow.

When you use AI features (lab summaries, protocol generation, chat assistant), patient data is transmitted to third-party AI providers. We apply automated PHI redaction before transmission — patient names, emails, and direct identifiers are replaced with pseudonyms. However, clinical details (lab values, diagnoses, medication names) are transmitted to generate meaningful clinical output.
By using AI features, you consent to this processing and confirm you have a lawful basis to authorise it under applicable health data law.
The AI features of the Service are designed to assist clinical workflow, not to replace clinical judgement. You agree that:
AI models can produce inaccurate, incomplete, or outdated information ("hallucinations"). We do not warrant the accuracy of any AI output. You are responsible for verifying all AI-generated clinical content.
We do not use your patient data or workspace content to train AI models. Prompts and completions may be retained by our AI providers subject to their terms, but are not used for model training by default.
You retain full ownership of all data you upload or create in the Service. We claim no intellectual property rights over your content.
You may export your data at any time through the Service. Upon termination or subscription expiry, we will make your data available for export for 30 days, after which it may be permanently deleted in accordance with our retention schedule.
Following the free trial, continued access requires a paid subscription. Pricing and plan details are published on our website and are subject to change with 30 days' notice.
Subscriptions are billed in advance on a monthly or annual cycle. All fees are exclusive of VAT or applicable taxes, which will be added where required by law.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods except where required by applicable consumer law.
If payment fails and is not remedied within 7 days, we may suspend access to your workspace. We will notify you before suspension.
You may close your account at any time by contacting us at support@expandhealth.io. Upon closure we will initiate data deletion after the 30-day export window.
We may suspend or terminate your account if:
Upon termination all licences granted under these Terms cease immediately. Provisions that by their nature should survive (including data ownership, liability limitations, and governing law) will survive termination.
The Service, including its software, design, trademarks, and AI features, is owned by Expand Health and protected by intellectual property law. These Terms do not transfer any intellectual property rights to you. We grant you a limited, non-exclusive, non-transferable licence to use the Service during your subscription term.
If you provide feedback, suggestions, or ideas about the Service, you grant us a royalty-free, perpetual licence to use that feedback to improve the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXPAND HEALTH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that any specific uptime will be maintained, although we aim to provide greater than 99.5% monthly uptime.
We do not warrant the accuracy of any AI-generated output. See Section 6 above.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPAND HEALTH'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ZAR 5,000.
IN NO EVENT WILL EXPAND HEALTH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms limits liability that cannot be limited by law, including for gross negligence, fraud, or death or personal injury caused by negligence.
You agree to indemnify and hold harmless Expand Health and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from:
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of South Africa.
Before initiating legal proceedings, both parties agree to attempt to resolve disputes in good faith through direct negotiation for at least 30 days.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by prominent notice in the Service at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
